Domain Hosting Policies
Please read the following policies carefully. They regard all forms of domain hosting and are here for both our protection and your own.
Update: The policy has been updated as of October, 2007 to further clarify the role Danen Consulting Services plays regarding domain hosting. Please review it carefully.
Acceptable Uses Policy
The following restrictions are imposed as terms of hosting services, whether it be web hosting, email, or any other service Danen Consulting Services provides. Accounts that are found to have or promote any of the following material will be suspended and/or cancelled without prior notification and without compensation for loss of sales or for hosting costs that have already been paid. No refunds will be issued.
- Any illegal material.
- Pirated software or links to sites containing such material.
- Computer hacking, phreaking, or virus information or links to sites containing such material.
- Any material that is in violation of copyright laws or redistributed without authorization or links to sites including such material (for example, illegal MP3 files).
- Subversive or racially intolerant material or links to sites containing such material.
- Obscene, lewd, violent, or pornographic materials or links to sites containing such material (including banners).
Danen Consulting Services has sole discretionary authority to judge the nature of an account holder's website content as to whether it is in violation of our Acceptable Uses Policy.
Account holders agree not to attempt to access unauthorized areas of the domain hosting and/or DNS and/or mail servers. Any malicious or otherwise unauthorized activity on any of the servers will result in immediate suspension and/or cancellation of the account without prior notification and without compensation.
Account holders agree not to use their email accounts as provided by Danen Consulting Services for the purposes of "spamming" (the sending of unsolicited advertising/materials via email). Accounts found in violation of this policy will have their account suspended and/or cancelled without prior notification and without compensation.
Account holders agree not to use their email accounts as provided by Danen Consulting Services to send any content or information that is in conflict with our Acceptable Uses Policy. Accounts found in violation of this policy will have their account suspended and/or cancelled without prior notification and without compensation.
Limitations of Service
While Danen Consulting Services takes every precaution to ensure domain account and service stability, the account holder agrees to hold harmless and indemnify Danen Consulting Services for any and all liability and/or claim arising from the malfunction of hosting services, including, but not limited to, any errors, omissions, interruptions, power failures, computer viruses, data damage, deletion of files, delays in operation, delays or failures of transmission, or any other failure of performance, including human error.
Liability
Any and all material within an Account is the property and sole responsibility of the account holder. Danen Consulting Services shall not be held responsible or liable for any illegal or inappropriate content contained within the account holder's website.
Background Programs and CGI Scripts
Background programs and CGI scripts are prohibited without direct written permission from Danen Consulting Services. Background programs and certain CGI scripts can utilize unacceptable levels of system resources, and impede the quality of the service we provide to others. If there is a need for such a program to be made available to you, please contact us for authorization and cost.
Refunds, Payments and Non-Payment
Setup fees for domain accounts are non-refundable. Fees collected for prepaid contract periods are non-refundable. All accounts with delayed or declined payments will be blocked automatically within 5 days (including weekends) after a reminder is issued, whether verbally or written. If no payment is received within 7 days after the 5 day notification period, the Account will be suspended and/or terminated. Accounts will be blocked immediately upon NSF cheques, and an additional $30 NSF service charge will be required prior to the re-activation of the account. Overdue accounts are subject to a 2%/mo interest charge. If an account is suspended, receipt of payment of the overdue amount, including interest, is required prior to re-activation of the account.
Accounts cancelled due to non-compliance with our Acceptable Uses Policy are non-refundable. Account holders are responsible for the domain registration fees to the appropriate internet Registrar; in the event that Danen Consulting Services has registered a domain name on behalf of an account holder, registration fees will be secured by Danen Consulting Services (pending account holder approval) with the applicable registration fees being passed on to the account holder.
Hosting and other fees are due annually, or as otherwise negotiated, on a pre-paid basis. Fees are charged anually in advance for the upcoming year. Hosting fees include disk storage for web site and email, bandwidth (communication) usage (including web traffic, email traffic, FTP traffic, etc.), site monitoring, and domain renewal services (if applicable).
In the event that Danen Consulting Services is managing (i.e. has registered on behalf of the account holder) the domain name, Danen Consulting Services reserves the right to keep the domain name(s) until any applicable unpaid accounts are paid in full as well as any further compensation deemed necessary before releasing or transferring said domain name(s) to any clients. When registering domain name(s) on behalf of account holders, said domain name(s) become the property of Danen Consulting Services unless other arrangements are made in writing. Danen Consulting Services also reserves the right to sell domain name(s) associated with unpaid accounts. If these terms are unacceptable to account holders, account holders should secure and manage their own domain name(s).
Danen Consulting Services reserves the right to revise these terms and policies as required without prior notification to clients.
